Program Requirements
To enter into the program, a defendant must waive a right to speedy trial, waive a right to trial, and stipulate that if the question of guilt or innocence has to be decided, (because the participant is being terminated from the program) it will be decided on the police reports. The defendant then has a two-week period within which to opt out of the program, no questions asked. If the defendant opts out, all the previously waived rights are restored, and a trial date is assigned..
Participants in CHART - Drug Treatment Court are closely monitored by the court and are required to submit to several urinalysis tests per week. They are required to report to the court regularly and frequently. They are required to attend group and individual treatment sessions, and several 12-step meetings per week. As they progress in treatment, the frequency of their court appearances and intensity of treatment will diminish.
