In the State of Washington, County Auditors are “Recording Officers’ or “Custodians of Records”. The Revised Code of Washington (RCW) statutes require the recording of legal documents. Statutes RCW 65 and 36 specifically define the minimum amount of information required for each instrument recorded and the fees to be charged for such recordings.
Because the County Auditor, and their deputy auditors are not practicing attorneys in their roles as recording officers, they are prohibited from giving or offering legal advice.
The responsibility for properly preparing an instrument, survey, etc for recording is that of the document preparer. It is not the responsibility of the Auditor or deputy auditors to screen the document to make sure it is properly drafted. The Auditor’s responsibility is limited to verifying the following information:
The Recording Division is responsible for recording real property transactions (deeds, mortgages, real estate contracts, liens and releases); recording plats and surveys; recording marriage licenses; filing public disclosure records for elected officials; microfilming and indexing the recorded documents; and providing public access to recorded and filed documents.
